Terms of Use
1. About RoboYap
RoboYap™ ("the Platform") is operated by MADNESS (FZE) ("we," "us," "our"), a company licensed in the Emirate of Sharjah, United Arab Emirates. RoboYap provides safe, moderated AI chat companions for children, with full parental controls. The Platform consists of two components:
- Parent Portal — a web-based dashboard where parents manage children's profiles, select AI agents, set household rules, pair devices, review flagged messages, and manage their subscription.
- Companion App — a browser-based chat interface used by children to interact with AI agents selected and configured by their parent.
By accessing or using RoboYap, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Platform.
2. Eligibility
RoboYap accounts are created by parents or legal guardians ("Parents"). You must be at least 18 years old and have the legal capacity to enter into these Terms. By creating an account, you represent and warrant that:
- You are the parent or legal guardian of any child you add to the Platform.
- You have the legal authority to provide consent on behalf of your child for the collection, use, and processing of their information as described in our Privacy Policy.
- You are responsible for monitoring your child's use and reviewing flagged content.
Children do not create accounts and are not required to provide any personal information to use the Companion App. RoboYap is designed for children of all ages. Although COPPA applies to children under 13, we apply the same parental consent requirements, parental controls, and privacy protections to all child profiles regardless of the child's age.
3. Parental Consent
RoboYap is a service directed to children of all ages, including children under 13. Before any child profile becomes active, you must provide verifiable parental consent in accordance with the U.S. Children's Online Privacy Protection Act ("COPPA"). The consent process is described in detail in Section 5.4 of our Privacy Policy.
By completing the consent process, you acknowledge that:
- You have read and understood our Privacy Policy, including the information about what data is collected from children and how it is used.
- You consent to our collection and internal use of your child's personal information as described in the Privacy Policy.
- You understand that you may review, delete, or revoke consent for your child's data at any time through the Parent Portal or by contacting [email protected].
- You understand that we do not disclose your child's personal information to third parties for their own commercial purposes.
4. Account & Authentication
Accounts are created and accessed using your email address. We use a passwordless one-time-code (OTP) system sent to your email — there are no passwords to manage. You are responsible for maintaining access to your email and must not share your sign-in codes with anyone.
You may delete your account at any time from within the Parent Portal. Account deletion permanently removes your personal data and all associated children's profiles, device pairings, consent records, and usage records (subject to the retention schedule in our Privacy Policy).
After account deletion, re-registration with the same email address is blocked for 90 days. After 90 days, all remaining account metadata (including the email hash and billing identifiers) is permanently deleted (see Section 8 of our Privacy Policy for details).
5. Free Trial & Subscriptions
5.1 Free Trial
New accounts receive a free trial of 50 messages over 30 days from the date of registration, whichever limit is reached first. No credit card is required for the free trial. The free trial provides access to all Platform features, including all AI agents and parental controls.
Parental consent is required during the free trial. No child profile will be activated without verifiable parental consent, regardless of payment status.
When the free trial ends (either 50 messages used or 30 days elapsed), the Companion App will no longer generate AI responses for any child profiles under your account until you subscribe to a paid plan.
5.2 Paid Subscriptions
Paid plans are billed monthly through our payment processor, Stripe.
- Subscription details, pricing, and message quotas are displayed at the time of purchase and on the Billing page of the Parent Portal.
- All paid subscriptions automatically renew each billing cycle unless you cancel.
- You may cancel your subscription at any time through the Parent Portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
- We reserve the right to change pricing with reasonable advance notice. Price changes do not apply retroactively to the current billing period.
5.3 Refunds
Refund requests are handled on a case-by-case basis. Please contact [email protected] for billing inquiries.
Unused messages are not refundable. Message quotas are included as part of your subscription plan and reset each billing cycle. There is no credit, refund, or carryover for unused messages under any circumstances — including voluntary account deletion, subscription cancellation, plan changes, or account suspension.
6. Permitted Use
You may use RoboYap to:
- Provide your children with access to AI-powered educational and creative chat companions.
- Configure household rules that govern AI behavior and topics.
- Monitor your children's AI interactions through parental controls and flagged message alerts.
- Pair and manage devices for your children's use.
7. Prohibited Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- Attempt to bypass, disable, or circumvent the Platform's content moderation, safety systems, or parental consent mechanisms.
- Create accounts on behalf of children — only Parents may hold accounts.
- Provide false information during the parental consent process or impersonate another person.
- Use automated bots, scrapers, or similar tools to access the Platform.
- Reverse-engineer, decompile, or disassemble any part of the Platform.
- Interfere with the Platform's operation or impose unreasonable load on its infrastructure.
- Resell, sublicense, or commercially exploit the Platform or its content.
- Use the Platform to generate or distribute harmful, abusive, or illegal content.
- Use the Platform in a manner that would cause us to violate any applicable child privacy or data protection law.
8. AI-Generated Content
The Companion App uses third-party AI language models (accessed via OpenRouter) to generate responses. While we apply multiple layers of safety — including real-time content moderation, customizable household rules, and agent-specific system prompts — AI-generated content may occasionally be inaccurate, incomplete, or unexpected.
We do not guarantee that AI responses will always be age-appropriate or safe despite our best efforts at moderation. Parents are encouraged to review flagged messages and adjust household rules as needed.
9. Content Moderation
Under normal operating conditions, every message sent to and received from AI agents is independently analyzed in real time against 14 harmful content categories using a specialized safety classifier. In rare cases where the moderation service is temporarily unavailable, messages may be delivered without independent safety classification; in these cases, the built-in safety rules in the AI agent's system prompt remain active as a baseline protection layer. Messages flagged as potentially harmful are:
- Blocked from being sent or displayed to the child (where applicable).
- Logged for the parent's review in the Parent Portal (with the flagged content and reason).
Parents may review, acknowledge, or delete flagged messages at any time. Flagged messages are automatically deleted 30 days after creation. Despite these safeguards, no automated system is perfect. We strongly encourage active parental involvement.
10. Intellectual Property
"RoboYap," the RoboYap logo, and all associated branding are trademarks of MADNESS (FZE). The Platform's code, design, and documentation are the intellectual property of MADNESS (FZE) and are protected by applicable intellectual property laws.
Custom agents, household rules, and child-specific rules you create remain yours. We claim no ownership over content you provide. However, by using the Platform, you grant us a limited, non-exclusive license to process that content as necessary to operate the service (e.g., passing your rules to AI models as system instructions).
11. Disclaimer of Warranties
We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure at all times.
- AI-generated responses will be accurate, appropriate, or free from errors.
- The content moderation system will catch all harmful or inappropriate content.
- The Platform will meet all of your specific requirements or expectations.
12. Limitation of Liability
To the maximum extent permitted by applicable law, MADNESS (FZE) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
Our total aggregate liability for any claim arising from or related to these Terms or your use of the Platform shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless MADNESS (FZE), its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Platform or any breach of these Terms.
- Content you provide (including custom agents, rules, or any data you input).
- Your child's use of the Companion App.
- Any violation of applicable laws or third-party rights.
- Your provision of false information during the parental consent process.
14. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, have provided false information during the consent process, or if continued access poses a risk to the Platform, other users, or children.
If your account is suspended (blocked) by an administrator:
- Any active subscription is canceled immediately and billing stops.
- All active sessions are invalidated and you are logged out of all devices.
- You will not be able to log in or use the Platform while the block is in effect.
- After 90 days, blocked accounts are automatically and permanently deleted along with all associated data.
- A one-way hash of your email address is retained on a block list for 24 months to prevent re-registration. This hash cannot be reversed to recover your email address.
You may terminate your account at any time by using the account deletion feature in the Parent Portal. Upon termination, your data will be handled as described in our Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and notify you via email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Emirate of Sharjah, UAE.
Notwithstanding the above, you acknowledge that the Platform is subject to the laws of the United States — including the Children's Online Privacy Protection Act (COPPA) — with respect to the collection, use, and disclosure of children's personal information, and we will comply with COPPA regardless of governing law.
The Platform also complies with UAE Federal Decree-Law No. (45) of 2021 Concerning the Protection of Personal Data ("PDPL") and its implementing regulations with respect to the processing, storage, and transfer of personal data. Details of our data protection practices, your rights under the PDPL, and cross-border transfer safeguards are set out in our Privacy Policy.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
